England, sued Stanley and Jamos O'Neill, pork butchers, for £150 for alleged nuisanco caused by smells' from defendant's shop. Evidcnco for plaintiffs was ■given'by-L.-'AV. Fowler, and Dr. Do Lisle, late District Health Officer. The last wit1105s stated inter alia that he was asked to como and inspect Miss England's rooms, and found, smoko -"present. ■Hβ found bad meat was'. being burnt'. . He wrote to tho council .to prosecute' O'Neill, and as tho council dojclined, hewroto tp'the Chief Health Officer, [for permission to prosecute. He obtained ppormission, .buf dclay'"ensuedj !, 'Hnu''Kis 'tf'ftnesses were not prepared' to stand by. him, so ho could not prosecuto. In cross-examina-tion he. stated that O'Neill said ho always "wanted to-oboy tho law, and.-the-place- wa3 clean. O'Neill novor obstructed- witness,'but rather assisted". him. Possibly: it was jtbo fault .of the gear. Ho had-.tscen- similar plant in other parts of the-dominion, and O'Neills' compared favourably with tho avorago plant. -._ J. F. Matthews, Inspector .of Nuisances, said there was_ a smell upstairs;. It seemed to como -ffonT-tho -back of tho.premises of the OiNcills. ; . : O'Neill' took , steps to remedy tho nuisanco-in , 'November or December . In cross-examination' witness said -tho_plant was-used, for ,-cookirig : small goods.;. Ho , had seen places liko O'Neills' in , the .main, streets of Ohristchurch, and/they were not ..objected to., '■,Tho. defendant •.admitted the smell, and asked witness to make an examination.' Oaa- hundred and twenty pounds;.were taken from all sources yesterday, making the total takings'for three, days £260. 'Tho poster competition was again tho "star", attraction, while the dramatic performances were also Crowded. During the evening the Mayoress (Mrs. Miller) presented Mrs. Scott with a handsome silver jewel casket, and carved oak tray, as a souvenir, and, in' appreciation of her great kindness, and untiring patience. The vicar (tho Hev. J... Hobbs) returned ■thanks"to'all the performers who had made tho exhibition such-" a success. Tho. result of -the: poster competition was declared today, and th'q prizes wero awarded to M; Johnson, first, for tho : most- beautiful costume; W.: Keith, builder, first, for Ihe most original; T.> Ritchie, plumber, second, for thp most original.
