At 3 sitting in bankruptcy yesterday morning,' an appeal was "'heard by his ; Honour, Mr. ', Justice in regard to a decision given by District Judge Haselden at Hftwefa a few months ago. Mr. Skerrett, K.C., with. him Mr. Ostler, appeared for tho appellant, Campbell, and Mr. W. IT. D. Bell for the respondent, Buckmaii. The
latter, was a bankrupt, and ho entered into ail agreement with a mail named Burgcs to purchase, by instalments, a stationary steam engine, "it was agreed that tlio engiuo siiould _ still be the property of Burgos uutjl all tlio instalments wore paid. Buclcman had been adjudicated a bankrupt on January 30, 1808. A meeting of bis creditors was held at Manaia on November 6, 1907. Fivo wore present, and the appellant, Campbell, agreed to buy the engino .for . £150 from Burgos,- 'who was a creditor to tho extcilt of about that sum. Campbell agreed to payto the other creditors present the full amount of tho debts due' to tholn out of, tlio profits of .the resale of -tfii« engine. 'J'h'o engino was sold for £300, and ,Campbell made n profit of - about' £100/ after paying ; the debts duo t<o-the other creditors who liad attended the meeting. Tlio Official Assignee applied to tlio District Court for an order that tlio appellant . should bo, inado to account to ,tho croditors for tho profits he had mado. .This order was issued, and the. appeal was nmv: -brought against the decision of t-ho District Court;. ... ,'His Honour heard argument, and reserved judgment. "
