RAILWAY APPEAL BOARD.
THE MARTON COLLISION, (EI TELEGBAPH—PRESS ASSOCIATION.) '. - Wanganiii, April 28. Tho North Island Railway Appeal Board was occupied all day hearing the conclusion of the evidehcoin tho appeal of J. A. Shelton against dismissal for his connection with a. collision'at Marton Junction. '■ . In his evidence, Shelton said that ho was instructed liy the stationmaster'to go out on the main line with' a shunting engine. The nrnil train was overdue, but he contended that he considered that'the signals would protect him, seeing 'that the stationmaster had given him' the orders. No sooner had the shunting engine got on the main 1 lino than the mail train appeared and collided with his engine. Other witnesses deposed to hearing the stationmaster ask Shelton .if he was' going out on tho line. Tho stationmaster to-day declared that tho shunt was made : without his authority, and was in direct contravention <of the practice vrhich obtained in the yard. Ho said that it was ppssiblo. tjiap Shelton had misunderstood an instruction regarding a different part of the yard. The Court reserved decision. .James M'Gurk, driver of theshunting en. gine, also appealed Against jiis dismissals He said that ho.was bound by the regulations'to .obey the instructions of Shunter 'SJieJto'n, who fold him to go out pp the main line. He could not see the signals; but'presumed, that the shunter would' not order him into danger. . ;• ■ The case has not concluded.
