A PATENT COPPER.
A patent copper was introduced in a claim for the recovery of , £60 by W. F. Eggers, land agent (Mr. Kirkcaldie), who sued A. H. Wood, builder, Auckland (Mr. Itirk). The statement of claim set out that plaintiff purchased a. quantity of fire-clay 'blocks and coppers from defendant, who warranted that tho articles were equal in quality and fitness to tho ordinary brick coppers.' < Plaintiff alleged .that tho articles were -not equal in quality and fitness to the brick; coppers in common uso, inasmuch as they would not draw, and wero useless. Plaintiff, therefore, claimed £60 .as damages for, br.eijch of warranty. '' l " Defendant stated that, he guaranteed to give plaintiff a better copper than the ordinary stylo of copper, and one equal to the sample which plaintiff had been shown at a house in Auckland. When plaintiff saw the copper in Auckland he expressed himself as satisfied with it, and gave defendant an order. The only complaints defendant had received from persons who used his coppers had boon when the user did not understand that the copper had to be lifted out and cleaned overy now and again. When this was understood tho copper worked satisfactorily in overy way. Several expert wit. nesses were called for both parties. After hearing evidence at length, His Worship reserved his decision until Thursday next.
