(with him Mr. Lovvy), appeared on behalf of tho plaintiff, and Mr. Skerrott, K.C!. (with him Mr. ; Von Haast), for tho dofondant. This was an action to recover £100, being a deposit lodged by plaintiff with defendant' as security for 0110 Martinson for tho fulfilment, of a contract in rospect to certain additions to Parliament House, and for damages for allogc'd refusal by defendant to permit plaintiff to complete tho contract with Martinson in respect of which tho doposit had been lodged as security. : Tho taking of evidenco had not concluded 'whon, tho Court adjourned until 10.45 this morning. . - QUESTION OF RIGHT-OF-WAY. Mr. Justice* Cooper yesterday hoard further ovidence and argument with referenco to the Wanganui caso of W. Mitchell versus F. A. Harkiiess, a suit for an injunction to restrain defendant from obstructing a-right-of-way •by building upon it. His Honour reserved his decision. Mr.- G. Hutchison appeared for plaintiff, aiid; Mr.; Myers for deiendant. : < ■ '■
