THE NEW PROTECTION
BIGfl COURT'S RULING. AN UNCONSTITUTIONAL METHOD, THE EXCISE ACT. BY TELEGRAPH—PRESS ASSOCIATION —COPYBIQHI (Rec. Juno 27, 0.30 a.m.) Melbourne, June 26. The High Court has given judgment in the Harvester cases, wnich involved legality of the new protection. The judgment of the Court was, by ■ a majority, against the Excise Act, under which the now protection was enforced in the Harvester and other cases. The Court held that tho Act in question was not . in substance an exercise of the power of taxation conferred on the Commonwealth Parliament by the constitution. Justices Higgins and Isaacs dissented from the judgment. Under the Excise Act the Government sought to charge the agricultural implement-makers full excise duty, on the ground that thoy had not paid their employees "fair and reasonable" wages. The employers appealed, and have succeeded, thus legally upsetting tho new protection principle.
