JUDICIAL DECISION. SCOPE OF THE ACT NARROWED. LANDLORD MAY VETO. BY TELEGRAPH—PRESS ASSOCIATION—COrTMGHT London, May 19. Tim Court of Appeal.at Dublin, over-ruling Mr. Justico Wylip's decision, declared that;' despite the fact of planters' or farmers' planted oil estates in place of evicted tenants offering to dispose of their interests' to the Estate Commissioners in order to facilitate the reinstatement. of evicted the. Commissioners wero debarred from acquiring sncii' land against the will' of tlio landlord's'. ' The case arose out of the proposed acquisition under the Evicted Tenants Act, 1907, of, 4000 acres of tlio Claiirica'rde Estate. The Court holds that compulsory acquisition applies, <>nly. t-o holdings of new tenants 'who. aro not bona fide tenants using or cultivating the land' as ordinary farmers'.
