CLAIM FOR FIREWOOD,-ETC,
The hearing of the claim, brought against the Government. by,, the • Public Trustee (executor, of. . 'the.' estate of the late. William Booth), oii bohalf..of, beneficiaries in. the Cat rington Estate in respect of certain timber' and tramway rights'. was resumed yesterday morning before his Honour the .Chief Justice (Sir- Robert Stout) and, Messrs. J. M'Kerrow (assessor. fox-.'the Government) and , Stevens (assessor for the Public Trustee). Mr: Myers'appeared'on'behalf of the Public Trustee, and Mr.'lX M. Findlay for the Crown. There were, originally, a number of items in the claim, but, on the previous day, the 'parties arrived at'an agreement, the offecfc of which was to settle all claims excepting one for firewood, piles, posts, and strainers, for which item £1290' was claimc'd. Evidence in support of the claim was given. . Mr. Findlay,'on behalf of the Crown, contended that the'claimant was not,-entitled, to at all. . Claimant had no exclusive right to cut timber. . v ■ Mr. Myers argued that the right was an exclusive license. .' , '' . ' v' Evidence was then given to the effect that most'of; the wood 'remaining on the estate ivas in inaccessible localities. ■ The Court, after a brief-retirement, unanimously found 'that claimant was, entitled to £200, in full satisfaction of all, demands. His Honour said that the, Court understood that there was to be no more cutting of firewood by the Public Trustee. Therefore the -Public.Trustee was entitled to the payment of the'amount awarded within a month; ■ His Honour' fixed the assessors' fees at seven guineasi'each and ordered each party to'pay it's own assessor. '
