At a divorce sitting of tho Supromo Court to-day Mr. Russell appeared in support of an application for a dissolution ofjiiarriago, ■■'•.' tho ground alleged being tho failure'of tho respondent to,comply with, an'order for tho [1 restitution of conjugal rights. His Honour d said that he had not soon'-tho Act of last s session. He supposed it had to bo sub--0 mitted for tho. assent, of His Majesty, but the Act was cortainly intended to do away with that sort of thing. ' Mr. Russell said ; > ho did not think tho Act had any retrospec'i' tivo' action. His Honour said ho thought ;-' there was a reservation to the effect that r tho Act should not projudico any impending proceeding. Ho understood that from a Press report, but if : the assumption was ■ wrong tho decree would bo void, and Mr. ' Russell would have to apply to havo it 1 rescinded. In tho meantime, ho.wouldtako .' the law as ho found it at present. In j granting tho decree, His Honour said that that form of rc'ady-mado desertion had at--3 tracted the attention of, Parliament, but 1 until tho law was altered parties, were en--1 titled to tho advantages of the system. In the Divorce Court to-day, before Mr. 1 Justico Ciiapman, Emily Tait petitioned lor tho dissolution of her marriago with Samuel Fullorton Tait, on tho ground of desertion. 1 Tho parties wero married in July, 1878, at i Chrietchurch, and the petitioner , said her ■ married life was unhappy owing to respondj ont's drinking habits.
