Thursday, Junb 20. (Before E. H. Carew, Esq., Judge and Warden.) VALE OF AVOCA QI7AKTZ CLAIM. R. E. Dagg v. John Jackson and six others.— The complainant in tbis suit alleged that the defendants (who are the holders of the claim above mentioned, and for which they had obtained a protection certificate,) had neglected to keep two men employed on the claim in accordance with the terms upon which protection was granted to them. Complainant therefore claimed that the said protection certificate be cancelled, add that the defendants be adjudged to pay costs of present suit. Mr P. J. Wilson appeared in support of the complaint. The evidence of complainant and another witness (George Guilford) went to prove that for several weeks prior to the 13th inst. the defendants had done no work on the claim. On the 30th of May complainant saw John Duff, one of the defendants, and told him that if they did not work the cla ; m he would apply for it. DulF replied that " they would chance it." The complainant marked off che claim the same ni'dit. Eor the defence, John Jackson stated that himself and Jacob Johnston, the worki.i" shareholders, had kuockwl off work about the end of May, with the object of getting the otlier shareholders to pay up arrears of wages.—ln crossexamination, witness admitted that he afterwards went to work in the Rob Roy. J. Johnston, the other working shareholder, staged that if Jackson and himself had got their money, there would have been no stoppage of work on the claim.—ln cross-examination, the witness said he was at present working in the Royal Standard. The Warden said it was quite clear that the conditions attached to the granting of protection bad not been complied with, and he therefore ordered that defendants' certificate be cancelled : defendants to pay 18s. costs of Court, and £2 2s. solicitor's fee. APPLICATIONS. Extended Clahns.—kh. Soo and three others, four acres, Nevis Gorge: granted.—Robt. (iirdwood and another, two acres, Nevis: "ranted. John Clode, one acre, adjoining Forsyth's claim Adams's Gully: granted.— W,n. O'DonneU and \ive others, six acres in Stewart's Gully, Nevis : granted.—Alfred M'Minn and three others, four acres, seventy yards north of Hanson's house, Kawarau Gorge, and partly situate on the main road. A leiter from the District Engineer, approving of the proposed diversion of the road, was banded in to the Warden, who ordered that a certificate be issued when the applicants furnish a report from the Engineer that a new road i has been provided to bis satisfaction. Protection.— Royal Standard Q. \I. Company, Registered, sixty days, (on account of inclemen weather): granted. —John Wrr.jht.son and five others, sixty days for No. 1 South of John Bull claim, Carrick, (to test reef) : granted, on condition tint two men be kepo employed. —Nil Desperandnm Q. M. Co., Registered, ninety days for prospictiug-claiui in Pipeclay Gully, (waiting for machinery): granted on same condition.— Win. O'Connell and five others, ninety days for alluvial claim in Stewart's Gully, Nevis, (on account of inclement weather) : refused, the claim having been only just granted. Tail Races. —The undermentioned applications were granted : —Ah Soo and three others, Nevis Gorge ; 11. Gird wood and another, Drummond's Gully, Nevis ; Andres Olson. Kawarau Gorge. Water Races. —G. A. Brown and another, four sluice-heads from Beudigo Gully: granted—Jas. Anderson, one head from Smothering Gully, near Liudis, and one head from lefo branch (f Archibald's Gully : gran'ed.—fin. Howard and two others, four heads from Camp Creek, near Lindis: granted. Dam. —The application of Andres Olson for a dam site in Happy Valley. Kawarau Gorge, was opposed by Timothy Gorman ; but the applicant having explained that the dam would not interfere with the objectors' race, the certificate was granted.
