RESIDENT MAGISTRATE'S COURT, CROMWELL.
"-- —o— Thursday, October 19. (Before Vincent Fyke, Esq., R.M., add I. Loughnan, Esq., J.P.) E. Broughton v. R. Brown.—The plaintiff sought to recover £2O for damage alleged to be sustained by her in consequence of defendant entering and breaking in upon section 7, block 111., town of Cromwell, and taking away earth therefrom. Mr Brough for plaintiff, and Mr Wilson for defendant. The plaintilF and defendant occupy adjoining allotments of land, and the evidence heard went to prove that the defendant had made an excavation to the depth of over seven feet close up to the boundary-line, thereby depriving of latural support a portion of the plaintiff's ground (en which a house had since been built). A number of witnesses were examined, but the evidence is not sufficiently interesting for publication. The Bench reserved their decision till next sitting of the Court (on Thursday, 26th). John Halliday v. Joseph Holliday : a charge of using threatening and abusive languige. Case dismissed, with of Court, lis 6d.
Alex. Wilson v. Landrickcn.—Claim, £l. No appearance of defendant. Judgment for plaintiff for amount claimed, together with 9s costs of Court, and £1 Is professional costs. Charles Hair v. James Lawrence.— Claim for £8 3s, amount of an 1.0. U. Defendant did not appear, but it was stated he had paid £2 into Court since receiving the summons. Judgment for plaintiff for £6 3"?, with 17s costs of Court. John Ben lie applied for a slaughtering license, which was granted.
