Henry Behrens and others, shareholders in the i All Nations Company, Bannockburn, were the I complainants in an action brought against 1!. J. i Gee, and another, of Shepherd's Creek, “to reI cover two sluice-heads of water at present tlow- ; ins' dow» Shepherd’s Creek.” | The case was Jieard before the Warden and I t!ie under-mentioned assessors, viz., Messrs John i B. Luscombe, John Arkoll, James Kelly, and j Charles Schultz. [lt will be remembered that some time ago i the Warden and four assessors decided (in the 1 case, M ‘1 can and others v. the All Nations Comi pair/.) that in accordance with the provisions of j the Mining Regulations, two sluice-heads of the I water then held by the All Nations Company : should be allowed to flow down the natural channel of Shepherd's Greek, between the hours of ■ S a.m. and 5 p.in. daily, “ for general use.” ; That decision was confirmed, on appeal, by the i District Court, —it having been shown that sej vend parties of miners had taken up claims on the creek, and that they required the water for I sluicing purposes.-] j After hearing evidence, the assessors decided I in favour of the complainants, in the followin')j terms :—“ We arc of opinion that the defendants have allowed water to run to waste, and that the two sluicc-hoads of water formerly ordered to flow down Shepherd’s Creek during nine hours per day is not now required for general use.” Verdict for plaintiffs : water to he restored to plaintiff)’ race. Defendants to pay assessors’ fees (112); cost of summoning assessors (245); and costs of Court (11s). ENCROACHMENT. Thomas Bane and others v. George Fauvcl and others. —This was a dispute as to boundaries of two quartz claims on the Carrick Range. The j hearing was adjourned till next Thursday, to | allow time for survey. APPLICATIONS. I Refolded Claims. —The following applications I were granted Archibald Sutherland and two | others, three acres in Stonewall (fully, Nevis ; : Robert Barnes and two others, three acres- in 1 Pipeclay Cully, Carrick Range. Brydon and five others, | for sixty days’ protection for a quartz claim adjoining the Star of the East, was opposed bv D. Moore and other?, and by R. Kidd and others. Refused.- pending the institution of a judicial suit within fourteen days. Water /face.—The application of D.
