—u Thursday, September 7. ? (Before Vincent Fyke, E*q., Judge and Warden. J 1 A WATER RACE DISPUTE. ’ Anders Olson and five others v. Timothy J Gorman and live others. The complaint set forth “ That the defendants arc the occupiers of a certain water- , race situate near the Lowbnrn, and that they ' have for some time past worked and managed' j their said water-race in such an unskilful ) and negligent manner that they have deprived the complainants of the support to which they are entitled to enable them to maintain their water-race in working order; and that in ’ consequence of the said negligence the coinv plainants cannot run water through the said 1 water-race; wherefore the complainants claim . that defendants be adjudged to make such 0 arrangements as to the Court may seem just for the purpose of enabling the complainants to enjoy the benefits to which they are entitled by virtue of their water-license.” The dispute w r as settled out of Court, the following memorandum being entered in the Court-book : “ Complaint withdrawn, on condition that - defendants assist complainants to repair the } complainants’ race by assisting with labour, and that should plaintiffs’ race break away ’ and injure defendants’ race, defendants will not seek compensation from plaintiffs. This to refer to break now complained of.” > UNLAWFUL INTERFERENCE. 6 H. Behrens and others v. G. Ramsay and i- another.—Damage claimed, £lO. Judgment e was given for plaintiffs, damages £2, lls costs e of Court, and £2 2s professional costs. Leave was given to enter suit for restitution of water : the suit to be heard before assesir sors. n G. Ramsay and another, v. H. Behrens and others.—A cross action.
