' Mr Jowm wished to call attention to the fact of ibe.bye-laws having been published four times since last .meeting. ' His interpretation of the Act was that these required to be published once, •then.the resolution to hold a special meeting to confirm fee .bye Jaws, to. be, published once every week for four weeks. The bye-laws he, held did not require to be published four times — only the resolution. . , The Clsbk contended that the bye-laws were part of the resolution,* and therefore had to be published four ticsea prior to the special meeting to confirm. The CHAIKI-A-T said such was his reading of the Act." The Clbbk said the City Council of Dunedin ■andfofcher Municipalities had adopted the same course. ,Mr Jowitt. said his reason for bringing the ' matter forward was that the ratepayers would complain pf the expense. Mr Dallas said he was formerly of the same opinion as the Chairman and Clerk, but now after considering the matter he had doubts of it. Mr Scott considered it a very unnecessary expense,* but if the Act provided for it they could ■not help themselves. - • ! Mr "SCOBIB was inclined to agree with 'Mr j •jbwrtT that only the resolution required to be published the four times— not the bye-laws. After further discussion it was agreed that .0-. future guidance a legal opinion be obtained upon the point.. , THE ADOPTION OS" THE BYE-LAWS. Mr Jowitt called attention to bye-laws no 1, which provided for the general meetings being called by the Chairman while the Act required the Council to fix these at stated times. He moved that the ordinary meeting 1 * be held after -each special meeting, such special meetings to be called by the Chaibman. He argued that appointing the general meetings to be held after ths special meeting, was a compliance with the Act as to ".stated times." .Mr Soott considered the Act contemplated fixed meetings — such as on a certain day ia each month, and thought Mr Jowitt's motion would not meet the case. ■ He moved as an amendment that the ordinary meetings be held at noon on the last Friday in every month. Mr Dallas took Mr Scott's view of the matter sod seconded the amendment. " After further discussioni Mr Jowitt withdrew his motion, and the bye-law was altered according to Mr Scott's amendment. The whole bye-laws were then adopted as amended. This concluded the special business.
