February 28, 1876. (Before E. H. Carew, Esq., E.M.) CowtK v. RiOhakdson.— Claim of L 3, value of a printer's block of a horse. Mr Henderson ap peared for the plaintiff. His Worship said he had received notice that an application had been made ts take defendant's evidence in Dttnedin. Upon the motion of Mr Henderson, the cas© was adjourned for a fortnight to allow time for the evidence being forwarded. Macdonaed v. Macfarlane.— Claim of L 7 Its 9d for timber. Mr Henderson for plaintiff. Defendant wished to lodge a set-off for labour, amount LlO, but Mr Henderson objected, as he had received no notice of it. His Worship suggested that the proper course Tfould be for defendant to bringa cross-action to recover his claim. • Defendant agreed to this* and-, confessed judg merit for amount .claimed. .. ;" M'Cr,osKiE v. Mr Henderson for plaintiffs ■•,;, Defendant pleaded not iudebieotand inability to pay* -?-,..- --(judgment for amount claimed with costs, Dr Smith vs Grat. — A judgment summons forL9 3s6d> Mr Taylor for plaintiff, William Gray> defendant, examined, said the judgment was obtained on the 13th September. He left for the Kumara oa the 4th October, where lie wrought for three weeks in the bush. He then went to Government work for tight weeks at 10a a day. He remitted LIQ to support his wife and family, and returned to the district about six 1 weeks ago. He had been working ; fourteen days for Mr Potter at Kaihiku, and was still in his employ afc 12s a day. He had only as yet received L 3 from Mr Potter. His Worship here stated that there was sufiicient evidence for him to make an ordei, and that from the manner in which defendant answered the questions, it was evident he did not wißa the Court to know the truth. Worship) made an order for payment of the amount by the 23th of March, failing which one month's imprisonment. Several cases were settled out of Court. There was no other business.
