Failure to Record Entries of Sale of Drugs
WELLINGTON, Nov. 11. ' Five charges of committing breaehes of tlie regulations concerning the drug tincture of opium were preferred against a Wellington chemist firm, J. R. Ounningham Ltd., in the Magistrate's Court today. Pleas of guilty were entered to all the charges. The Magistrate, Mr. J. Hessell, after hearing sunniission adjourned the fixing of the penalty to enable further written submissions to be made. Mr. W. R. Birks proseeuting, said the chax-ges had been laid not because of any illicit intention on the part of defendent but beeause his offenc.e had opened the way for the improper use of the drug. The offenees, said Mr. Birks, appeared to have been due to muddlement more than illicit intent. Investigations had shown that over three years 56^ lbs. of opium handled by defendent eould not be tracedi Defendant had failed to make entries of saies of the drug, had made false entries ana had failed in other directions to compiy with the regulations. Counsel for defendant said there was n o question of defendent selling the drug to addicts. Defendant had used it in a eough mixture.
