LONDON, Nov. 3. A six hit by a Manchester crickets er may involve an appeal to the House of LOrds with costs of £5000. The Court of Appeal by a majority awarded £104 damages to Miss Bessie Stone, aged 53, who had claimed against the Cheetham Cricket Clu'ft, Manchester, because a hall hit out of •the club's ground hit her on the head. Miss Stone had appealed against the dismissal of her claim by Mr Justice Oliver'who held that there was no negligence or public nuisance by- • the club, and that the hit had been an exceptional. one. Lord Justice Singleton held that because balls had been hit oiit of the ground before the club knew there -was a risk "and should have taken reasonable care to avoid injury to anyone on the highway. Lord Justice Somervell, who dissented, gave Ieavo to appeal to. the House of Lords. The action will have cost £5000 when it has been heard . by the House o£ Lords.
