Lone Motorist Need Not Report Mishap
DUNEDIN, Sept. 26. The contention that there was no obligation in law on a motorist travelling alone to report an accident in which no other vehicle was involved, was npheld by Mr. J. D. Willis, S.M., in the Magistrate7s Court when, in a reserved jndgment, he dismissed a charge of failing to report an accident to the nearest police station. • The case arose from an aceident near Alexandra in which a car struck a rock and capsized, the driver being injured and later assisted from the car by a passing motorist. There was a heater in the car and it was assumed that this caused the driver, who was travelling alone, to doze off. In his judgment the Magistrate quoted the former Chief Justiee, Sir Michael Myers, that "the underlying idea of the section was to ensure as far as possible the proteetion and safety of the injured person so that he might not be left in his injured condition to run the risk of further injury by reason of his being left on the road, or perhaps to die for, laek of attention.7'
