Impertinent Appeal Remarks Judge
CHRISTCHURCH, August 8. When Alan Robert Taylor, aged 22, barman-porter, appealing on grounds of undue severity against a sentenee imposed in Ihe Magistrate's Court oi' three months' imprisonment for the theft of a bicycle, said in the Suprem Court this morning that there was not inuch he could sav in support, Mr Jus tice Northcroft, emphatically agreed with him. His Honour asked Mr A. W. Brown to draw the authorities' attention t the state of the law in respect of ap peals against Magistratcs' sentences. "Merelv by lodging this impertinent appeal, this man obtained immediate release from prison, the Magistrale having no option in law but to release him," Said his Honour who pointe-1 out: "He has taken advantage of hL freedom to commit another theft on
1111 -L-U — ' ^ - ' the very dav of his release or the fol lowing day. The system is open to grave abuses and in his case has been gravely abused. In the case of a first offender it is appropriate but Magistrate® should have some discretion when an impertinent appeal like this is lodged. by an offender with this man's record. " The appeal was dismissed.
