He remained abreast of the other vehiele for approximately 100 yards and, after passing it, proceeded at 40 m.p.h. The defence was a denial of the charge, stating the vehiele was passed immediately. Inspector J. H. R. Semple, who accomptinie'd Inspector Mason, corroborat.ed his evidence, and defendant was convicted and fined £2, with costs 10s.- - j George Scullen, driver of a news- 1 paper van, appeared on a similarj charge. Inspector Semple said that! defendant drove on his incorrect side of the-, road whep.'delivering a paper at •Paraparaumu' t: and': fcoh- . tinued up the railway ramp, stilLon his wrong side. The case was defended and Scullen admitted proceeding on to. the incbrrec.t side, but said that as he copld see clearly either-way.there was no danger. A conviction 'was entere'd and a fine of £2 inflicted, with costs 10s. . McFarlane, Transport, Ltd. (Mr. Bergin) was charged with driving ■ a motor vehiele carrying an excessive' weight. ; The penalty- was £1 with costs 10s. Southern Cross Distributors, Ltd., pleaded guilty by letter to a charge of having no cer'tfficate of fitness and no heavy trafflc licence. The case arose following the charge against Scullen. A letter stated that t'he vehiele concerned had been operating in another area under different conditions, and when placed on its present route the matter of altering its status was overlooked. , Current licences .were held, but not for the previous quarter. A fine of £1 (costs 10s) on the first charge and £4 (costs' 10s) on 'the second. Inspector Semple prose.cuted. /•=• ' I J.'Rl VifiPerit was charged by In- • spector C. L.
