Dispute Over Plans For Dwelling
Claiming £25, H. A . Egden, for whom Mr. B. H. Rhodes appeared, proceeded against B. J. Kelliher, who was unrepresented by counsel in the Magistrate's Court, Otaki, on Friday. The claim was for a blue- . print and sketch plans of a dwelling. Egden stated that he had drawn sketch plans, which he had submitted to Kelliher, until approval j was finally given for a certain design. He knew- Kei.iher owned a , section, which he had inspected, j and he considered Kelliher knew| the terms and engaged him. Kelliher stated there was no de- ■ finite engagement. There had beenj discussions regarding p]ans for a j beach house and they had come to a mutual agreement. Egden stated that he was prepared to furnish a b'ueprint, but no price was men■tioned. The first in'timation he had of any charges was when he received a let.er claiming £25. His solicitors had offered £5 5s, which was considered a reasonable amount. "The only conciusion one can draw is that at a certain stage Lgden was ciearly directed to prepare the working drawings," said Mr. A. M. Goulding, S.M. "Kelliher !must have approved the design. Tbat is what resulted in the blueprints being prepared. This was skilful work well done, and would have cost more if an architect had been employed. A very carefully prepared working drawing was furnished and has to be paid tor £5 for first sketches is in my opinat the proper rate. The charge of ion not justified, but the other charges I find are reasonable and proper. I, therefore, give judgment for £20." Costs were also allowed.
