Theft By Means Of False Pay Sheets
AUCKLANt), Nov. 3. All three meh who have been on.trial since. -Tuesday of.last week, on charges pf taking from the Public Works Department over £1Q00 by means of f'alse vouehers for pay, were found ; guilty this afternoon- on all the charges of theft and forgery remaining against them.- Mr. Justice Fair remanded them for sentence until next Tuesday. & The jury-was absent for three hours before bringing in a verdict. Smith was found guilty on 14 charges of forgery and 23 of theft, Delich on nine charges of theft and Brown on three charges of theft. In the - ease of Brown, the jury added a recommendation to lenieney cn the ground that he was - the victim o. cireumstances. Smith and Delich w'ere remanded in custody but in view of the recommendation of the jury, Brojvu w&s released on bail on his own recognisance of £100. Counsel said he was considering stating a case for appeal on the ground that his Honour ha.d misdireeted .the jury on the delinition of theft. His Honour said that, if necessary, he would hear counsel on Monday.
