An order nisi was granted today 6y Mr. Justice Earry, calling upon iar. and Mrs. NoeJ J.enkins to sho-.v cause wliy a writ oi' haoeas corpus siiould not te granted requiring tfcem to surrendel' tiie child known as Doella Jeniins, ag^d tliree. Mrs. vviiliam lViO-rison ciiarged tkat tiie statf oi tiie Kyneton District Hospioal coiifused the identity of two ^aliy girls born within minutes of each other three years ago. The iaorrisons propose that the Jenkinses snould accept the child reared as ..ieir daughter and known as Johanne uee Morrison, in return for NoelJa J enkins. The Judge rnled that a prima iacie case had been made out for the Mor risons and granted the order so that the matter could he properly investigated. Mrs. Morrison made an affidavit that aiter the birtii a sister brought ner a dark haired baby which earried no identification tag and that, as the baby grew, it became unlike her- " sclf, her husband or their other childien. At a race meeting she saw Mrs. J enkins wheeling a prani wherein was a fair, blue eyed child. Witness had blue eyes and Mrs. Jenkins brown. Biood tests taken of the Morrisons and child Johanne proved that she could not be their child. The Jenkinses had refused to blood x-est the child Noella.
