Mr. F. Baxter, counsel for thei prisoner, sard the island had a ^population of about 4Q00, and the people lived a very primitive life. It was a povertystricken island, the natives relying for a livelihood on the sale oi ■ bananas to New Zpaland. Iliere was one school for European children and one missionary. Two other schools were run for the benefit of the natives. The chief of 'police was also prosecutor, regis--trar, and clerk of the High Court. TJnless four of the six assessors who eamprised the High Court coneurred with him, the judge could not convict a prisoner, but he could over-rule -the assessors if ;they returned a verdiot of -guilty and he consi'dered the evidence showed the prisoner to be innocent.
