Racing Conference Rejects Appeal

WELLINGTON, June 3. The liearing of the appeal of J. H. Marshall, Titahi Bay, to the New Zealand Racing Conference against the decision of the Auckland district comniittee which confi.rm.ed the avtion of the judicial couunittee of the .Auckland Racing Club in relegatMg Howe>" to third piace in thp 1947 Auckland Cujx, aud piacing Balgowan first and King's Kansom second, was completed in Wellington tonight. The judges dismissed the appeal and in the -course of a Lengthy judgment/found thot Howe did iaterfere with the chances of Balgowan by boring towards the outside of tlie course in the straight and carrying Balgowan with him, and from then on seriously hampered hixn and bumped him and i'estricted the riding eiforts of his jockev. At the same time there was some lesser interference with King's Ransom but his rider was not so restricted. The judges ordered tha4 Marshall 's appeal deposit of £20 be forfeited. It was further foiind that H. V. Lunk'eu, . owner of King's Kansom, who ajso appealed on the grounds that his horse was interfered with to a far greater extent than Balgowan, had not' complied with the requirements of the Kules ,of Racing in formulnting his appeal which was therefore rejected. The appeal judges 'were .Messrs J.- McUarlaue Lgiug, of Masterton (chairman), P.'A. O 'Neill, of Wanganui, and J. Grahain, of Eeilding.-
