WANGANUI, May 17. Two charges against B'ernard -McKay, a comniercial artist, of sending a eireular to a person with inteiit to induco liim to invest money 011 a • racehorso were dismissed today by Mr. Salnion, S.M. Two of- those who rceeived circu'lars were deteetive-sergeants. They applied to McKay 's Turf Analysis Service for details of the scheme. Prosecutions followed. The-defence was that the typewritten • and printed matter published by McKay was not within the Ganiing Act, in that it referred aJways to investments 011 the totalisator at the racecourse. Alr. Salmon held that the presenco of an investor on a racecourse, whefe lie musr consider eertain local factors and conditions l)efore investing, was essential to McKay 's Turf Analysis Servi.ee. He said he was satisfied that the scheme could not be operated fully oll' the course, and as the speciiic section of the Gaming Act did not apply to investments 011 ■ the totalisator, it also did not apply to publications in tended to induce any person to. apply for advice on totalisator betting.
