PARCEL LOST: COURT CLAIM

JUDGMENT AGAINST TRANS-' FORT COMPANY In Ihe Magistrate's Gourt, ' Levin, on Friday A. L. Robinson, 'cycle dealer, claimed the sum of £7 ls ld from the Macfarlane Transport, Company, as representir g the value of a package of cigarettes and tobacco handed by him to the company for delivery in Wellington, and which had been lost. The company did not admit having reeeived the parcel and accordingly denied responsibility. Mr. N. M. Thomson appeared for Robinson and Mr. J. Todd for the Macfarlane Transport Compary. Evidence was given by Robinson and N. B. Henderson to the offect that the parcel had actually been left by Robinson m the company's office in the presence of several of the company's drivers. It was stressed by Mr. Thomson, on behalf of Robinson, that the loss had been occasloned through the lack of any system iu use by the company for the giving of receipts for all goods entrusted to it for delivery. Robinson himself, in evidence, stated that he had sent a large number of parcels to Wellington previously and* had never been given a receipt. Claude McLeavey, manager of the company, "admitted in evidence that the system had had its draw- 1 backs, - but had " been * improved recently. He was inclined to doubt Robinson's evidence as to the identhy of one of the drivers stated to have been in the office when the goods were delivered. , The magistrate, Mr. A. M. Goulding, S.M., stated that he did not think that this- had any 'bearing on the matter. .He was perfeetly satisfied that the parcel had been delivered by Robinson to the company's office. Thereafter the blame lay with the company in the faulty system it had followed in failing to give receipts for goods entrusted to Lt. Judgnaenit was given ;acoordingly in faVour of Robinson for £7 ls ld and court costs £2 18s.
