WELLINGTON, August 12. Claiming £67 18s special damages and £1000 general damages for injury to his eye eaused when a barihan at the Roval Oak Hotel threw'a piece of a glass at a customer on November 22, 1946, Charles Petterson, aged,. 63, gardener was awarded the special damages claimed with £625 general damages. Mr. Justice Fair, who heard the casr with a jury, said Dr. O. C. Mazengarb's subsecjuent motion for ju^lgment foi plaintiffi would be reserved as wel) as judgment on a legal point as to whethei the defendant company, Royal Oak Hotel, Ltd., 'was responsible for the action of the barman in throwing the piece of a glass at the customer. The evidenee showed that a man who was making himself a nuisance in the hotel bar threw his glass at the barman.' 1 The barman, telling the man to get to hell out of it, picked up a piece of the base of the broken glass and threw it at the man who had tlirown it at him. A piece flew off and struck plaintiff's right eye. ,
