UNUSUAL VERDICT AGAINST CROWN

WANGANUI, August 10. After a retirement of nearly two liours a jury in the Supreme Court here on Saturday awardecl £195 damages agaiust the Crown in the ease in which Burton Wallace Vineent, faetory foreinan, petitioned for £750 pn the grounds tliat levelling operations' on adjaeent land takcu over by the Housing Department had caused damage' to' his property in Swiss Ayenue. The foTeman of the jury said tliat the Jinding, vvliich was unanimous, was based on uegligeiice. Vineent alleged tliat the levelling operutions which involved the reniovai of a liill liad ' resulted in sanij causing considerable nuisance. After the jury had announced its finding Air. A. G. Horslev, for Vineent, moved for judgment, but Mr. N. R. Baiu, who appeared for the Crown, had raised argunient earlier in support of a iiiotion for a nonsuit. Mr. Bain asked 14 davs in which to consider the motion for a' nonsuit as an important queation of priuciple was involved, he said. Mr. Justi'ee Christie accordingly reserveu judgment.
