WANGANUI, April 2. A ease of interest to sheep farmers was decided hy the Magistrate's, Court, Ohakune, today when Mr. A. Coleman, S.M., on grounds of excusability, dismissed an inforrnation laid by the Inspector of Awards .that a shearer shore sheep on a Sunday eontrary to the terms of the shearers and shed hands' award. Defendant was Gordon Gaulter ^50 was charged with shearing sheep on Sunday, December 8, at Mount View Station, Fordell. The magistrate found that a breaeh of the award was committed but nnder' circumstanees that, xras excusabie. (' That is not to say that if other prosecutions are made for a similar breach convictions will not follow," said M» Coleman.- "Each would be decided oi/ its merits. The faets of the hase had to be strong to warrant dismissal, and in this case the facts were-strong enough for that." Eigiit other informations laid by the Inspector of Awards arising from the, same set of eireumstaiices "wero with* -drawn when the dccision in Gaulter's case was announced.. The defence was sponsored by New Zealand Federated Farmers.
