POLICE THEN OFFER NO EVIDENCE

By Telegraph-

GII1USTGHLKGD, Aug. ix. - When William Maxwell Manchester, aged 33, medical practitioner, was eliarged in. ihe Magistrate's Court on Saturday with being in a state of intoxication while in chargo of a motoi car on August 9, Senior-Sergeant G. II. Holt asked for a remand until Mondav.. Mr. W. E. Simes, J.P., who was on the Bench. said the usual procedure of asking for a remand when eharges were laid before Justices, was appreciated but he could see no reason why Justices ! should not oarry out the duties which thev were appointed to porform. Magis- ; trates were greatly overworlced. ln his opinion two Justices could very vell deal with the charge before the Court and he saw no xenson to adjourn il J while Magistrates were so busy. As a I'doctor who had examiued defendanl I was not uvailable to givc evideuce, hc would adjourn the case until seven ' o 'clock that- evening. j Counsel, Mr. T. A. Gresson, said there i was an answer to the charge which | would be defended. The Court then rose and resumed at 7 p.m. in the central policc station when Mr. Arthur Rose, J.P., was on the : Bench with Mr. Simes. j Senior-Sergeant Holt said his instrue- . tions were to ask for h remand until Mondav. There would be a conflic| ot ■ evideuce and the doetor's report would be against the police. Th.ere was, however, tlie possibility of obtaining furfchcr evidenee and he asked for timo 1 to secure that evidenee. j Mr. Simes: I am wondering just vvhat further evidenee can be produced. | Seinor-Sergeant Ilolt: I am not quite | sure but it may be possible to collect. 'further evidenee from attendants at the j dance hall at which defendant was goihg to attend. I Mr. Gresson said it was possible that no evidenee could be, advanced against : his client in face of the certiiicate J furnished to the poliee by Dr. Scott. Mr. Simes then indicated that the Bench was not prepared to grant a remand. Senior-Sergeant Holt: Am I to understand that the Court wislies to proceed with the charge? Mr. Simes: That is the wisli of the Court. Senior-Sergeant Holt: Tn that case no , evidenee will be offered by the policc. : Mr. Simes then said the only conrse open to the Court was to dismiss tlie . eliarge on payment of costs, i Mr. Rose coneurred saying: "Tlie information is dismissed. " Mr. Gresson said it should be made ' plain that the doetor's certificate in5 ! dicated that defendant was Ln a iit con1 dition to drive the car. , . ' Mr7 Rose:. The press can see that the 1 police have no ease and I am happy to e leave it at that. The clutrge "yras dismissed.
