AUCKLAND, -Inly 5. "If the practice has grown of ado]iting a 5 per cent. return to tlio lanulord 111 the case of fiats, instead of 41 per cent. allowed the landlord of an .ordinary dwelling house, then I prefer to follow it in this case," said Mr. L. G. II. Sinelair, S.M., in a reserved judgnient at Auckland on ' a ckuni heard j under the Fair Iien ts Act, by Herbert Friedlapder, landlord of Mayfair flats.j who aslced that the reuts of the fiats be lncrcased to allow hiin a 5 per cent. return 011 his investnient. The claim I was opposed by 30 tenants. The Magistrate said lie would allow the usual- 41 per cent. return and also £612 for administration and services compared with £41.5 shown in Deeember, 1942. The jMagistrate added that it was stated applicant was a refugee alien who had acquired c-onsiderable means during the nine years he had been in New Zealand but it would be wrong to tako into account the fact that a landlord is an alien. He was entitled to exercise and eujov a propertv owner's rights as if he were a Britisli subject.
