The condemned man, Leonard Holmes, aged 32, ex-serviceman, of Nottingham, was sentenced last IMarch for the mufder of his wife whom he alleged was unfaithful while he was serviug abroad. The appeal brings into debate the whole qtiestion of the uimritten law — the defence of provocation by a husband who, believing his wife has been unfaithful, kills her. The decision made by the Lords will bear on everv future case of this kind and will be of vital importance at a time when so many men are returning after long service overseas. Holmes, at the trial, descrihed a quarrel in the heat of which the wife aliegedly confessed unfaithfulness. He said he hit his wife with a hammer, adding: "1 did not want to see her suffer so put niy hands* on her throat. "
