Jail sentence on assault charges
A jury in the District Court yesterday found Hector Francis Gavin Johnstone, aged 34, a supervisor, guilty of charges of indecently assaulting, and assaulting a deaf-mute man, aged 20, last October 6.
Judge Pain remanded him in custody to February 27 for sentence. Evidence in the trial was heard on Tuesday and Wednesday and the Judge summed up yesterday morning, before the jury retired to consider its verdict.
Mr G. K. Panckhurst appeared for the Crown and Mr B. McClelland, Q.C., and Mr C. D. Eason for Johnstone.
The complainant’s evidence was given through an interpreter of hand signs and lip-reading. His evidence was that
after visiting a friend in Linwood the complainant went to a bus stop to return to Cathedral Square. He asked the defendant, who was looking at vehicles in a car sales yard, the time and the defendant offered to take him into the Square. He was told the time was 11.30 p.m. Instead, the defendant drove to another area of the city and the assault and indecent assault then occurred according to evidence. After being driven back to the city the complainant noted the defendant’s car registration number.
The defendant denied any Involvement in the matter and defence evidence was that he arrived home at 11.30 p.m. and stayed home after this time.
