Rugby Union to seek appeal
PA Wellington The New Zealand Rugby Union will appeal to the Privy Council in London over legal action which effectively cancelled the All Black tour of South Africa last year.
The N.Z.R.F.U. chairman, Ces Blazey, said yesterday the union wanted to establish whether individuals had the right to challenge similar tours in the future. The union had decided after lengthy discussions with its lawyers that an
appeal would be worth while, he said. The tour was cancelled in July last year after two lawyers contended in court that by accepting the invitation to tour, the N.Z.R.F.U. had breached its constitutional obligation to act in the best interests of the sport. A High Court Judge, Mr Justice Casey, ruled that the players could not leave New Zealand until the case had been heard in full, although the case was adjourned before the
Court had reached a decision.
The Prime Minister, Mr Lange, said the Rugby Union had an absolute right to take the case to the Privy Council. Speaking at his postCabinet press conference yesterday, Mr Lange said it would be a matter for the judicial process to establish whether the Rugby Union’s case was successful.
Mr Lange said the Government would not make submissions on the case.
