Escaper given discharge

PA Auckland A Mount Eden Prison escaper, Cedric Albert James, aged 32, has been discharged without conviction. James, charged with escaping, was serving a seven-year term, and failed to return from day release after being involved in a fatal motor accident on January 30. He told police he needed more time out of prison after the accident, Sergeant Phillip Wirth told the District Court at

Auckland yesterday. James admitted the escaping charge. Sergeant Wirth said James was convicted in the High Court at Whangarei in 1981 on charges of causing grievous bodily harm, wilful damage and receiving. He was due to be re-

leased on parole on Tuesday, but after the accident he evaded the police on the pretext that he wanted to get something to eat from a take-away bar. His lawyer (Mr Roger Chambers), said James was distressed because a pedestrian had died in the ■accident, and went to visit

a senior Maori Affairs officer. He later gave himself up to the prison. Judge Taylor said he could understand James’ reaction to the accident, and discharged him. James’ case will now be reviewed by the parole board.
