‘A.C.C. not liable for some I.U.D. injuries’

PA Wellington Many women who suffer illness or injury through the use of contraceptive I.U.D.S will not be eligible for compensation through the Accident Compensation Corporation, a spokesman said yesterday. The corporation’s compensation controller, Mr Harry Lynch, said that as there were known risks in the use of all I.U.D.S, any resulting illness or injury was not regarded as an accident.

However, he said, all women had a right to claim for compensation as

each case was treated on its merits. If the I.U.D. had moved after insertion then the claimant was not automatically entitled to compensation, said Mr Lynch. A woman did . have a right to compensation when it could be proved that she was damaged or illness resulted from an error on the doctor’s part at the time of insertion. Mr Lynch yesterday denied reports that an Accident Corporation review decision last week would make it easier for women injured by I.U.D.S to claim compensation.
