Broker sentenced
PA Wellington A man has been sentenced in the High Court at Wellington to 100 hours community service after pleading guilty to the theft of $6OOO by failing to account.
Kelvyn Alfred Mudgway, aged 45, a broker, had acted
as agent between the purchaser and vendor in a contract for the sale of an owner-driver business, said Mr Justice Greig.
As agent he received $6OOO deposit and paid it into his own or his company’s bank account without paying it on, which amounted to theft. Although it was a serious offence and
a breach of trust, Mudgway
was in effect a first offender.
Other charges on which he had previously been sentenced all arose from the same business collapse, his Honour said.
