PA Wellington A big review of New Zealand law is imminent. The Minister of Justice (Mr McLay) wants the Law Reform Council to review all public Acts of Parliament passed more than 50 years ago.
The Minister, who is chairman of the council which co-ordinates law reform activities, said the review would embrace all the English laws passed before 1840 which were deemed to apply in New Zealand, New Zealand public Acts of Parliament more than 50 years old and still in force today, and all statutory regulations passed before 1936 and still in force.
The council met yesterday for the first time since 1976.
“Such a method of clearing out old laws from the Statute Book is much more preferable than the sometimes-suggested ‘sunset law’ that is automatically repealed after a period, such as 50 years," Mr McLay said. “Overseas experience suggests with a ‘sunset law’ little thought is given before the old law is reenacted. The council’s review will ensure that our old laws and regulations are current, desirable and acceptable.” Mr McLay said the council also decided that law reform committees should consider the possibility of appointing suitably qualified lay persons when dealing with particular topics in which they had expertise.
