JUDGMENT SOUGHT

Move Against £5427 Award A motion for judgment in favour of a defendant against whom £5427 damages were awarded last June was argued before Mr Justice Macarthur in the Supreme Court yesterday. Mr G. S. Brockett sought judgment for the representative of the estate of Trevor George Roberts, a motor-cyc-list killed in a collision at Dunsandel in 1963, against whom William Henry Donald Barnett, the driver of the car involved, had been awarded damages. Mr B. McClelland (with him Mr E. O. Sullivan) opposed such judgment on behalf of Barnett. His Honour reserved decision. Barnett, in a four-day suit early in June, had sought £lO,OOO general and £3790 special damages for injuries he suffered in the accident. A jury awarded him a total of £12,061, but reduced it by 55 per cent to £5427 because of his contributory negligence.
