REHEARING GRANTED
Traffic Case Appeals Of three appeals heard on traffic cases by Mr Justice Wilson in the Supreme Court yesterday, one was dismissed, one upheld, and a rehearing in the Supreme Court granted on the third. The rehearing was granted on an appeal by Clutha Forbes Mackenzie, a student, against four months’ disqualification from driving for speeding on Blenheim road after his counsel, Mr A. Hearn, had complained of the incompleteness of the transcript of evidence in the case. Several interruptions and rulings made by the magistrate had not been recorded, said Mr Hearn, and a substantial point in Mackenzie’s own evidence omitted. His Honour said that this matter should be taken up with the magistrate who had signed the evidence—but because of what amounted to an inaccurate record, he would grant a rehearing in the Supreme Court on a date to be fixed. Appeal Upheld An appeal by Stephen James Bird, a workman (Mr C. B. Atkinson) against nine months’ disqualification from driving for failing to produce his driver’s licence was upheld, on the ground that the disqualification had been without jurisdiction. Dismissed An appeal by Tehoia Wikirlwhi, a lineman (Mr S. G. Erber) against three months’ disqualification from driving for failing to keep to the left was dismissed. Mr C. M. Roper (for the Transport Department) had submitted that the appellant was lucky not to have been charged with a more serious offence, as a traffic officer had felt justified in taking his car keys from him, as he had been drinking, and had only got the keys with some difficulty.
