WELLINGTON, Mar. 10.

The Court of Appeal today dismissed an application for leave to appeal against conviction and reserved its decision on leave to appeal against sentence imposed or Noel Edward de Mahnanche ■sentenced on a charge of nothing and assault in the Paparoa i prison, appeared in person. He appealed against conviction on the grounds that the jury had taken a long time to reach the verdict and the judge had misdirected them in that he had not put all the relevant points to the jury. His appeal against a sentence of imprisonment was on the grounds that such a sentence could not be imposed to be served after a sentence of life imprisonment Further, he also submitted that his sentence was too severe having regard to his good behaviour in prison. The Appeal Court consisted of Mr Justice North, Mr Justice Turner and Mr Justice McCarthy.
