Judge Reserves Decision Describing the case as of “some importance,” Mr Justice Macarthur reserved his decision in the Supreme Court yesterday in the action by a petrol-selling firm, Straven Services, Ltd., which seeks to set aside decisions of the Waimairi County Council, which has refused the firm permission to develop its premises in Straven road, near the corner of Fendalton road, and the Town and Country Planning Appeal Board, which upheld the council on the firm’s appeal. Straven Services, Ltd., wished to build a modem service station on its site on Straven road, but was refused permission by the Waimairi County Council in June, 1964, on the ground that it would create inconvenience to traffic. Straven Services has accordingly sought writs of mandamus and certiorari against the council and the appeal board, to seek a setting-aside of their decisions and a rehearing of its application to develop its premises. After Mr J. N. Matson had yesterday made submissions on behalf of the Christchurch Regional Planning Authority, and Mr P. T. Mahon had summed up the case for Straven Services, in reply, decision was reserved.
