ASSAULT CHARGE
Constable Acquitted
(N.Z. Press Association) AUCKLAND, Feb. 4. Mr J. R. Drummond, S.M., today dismissed a case in which a police constable was charged with assaulting a man in the Auckland Central Police Station cells on
October 30 last year. The constable, Frank Wilson Moyes, pleaded not guilty in the Auckland Magistrate’s Court to a charge of assaulting Tomasi Toakuaole Semulana.
After hearing prosecution evidence, including that of the complainant, the Magistrate said that he could not convict Moyes on the evidence given.
He said the complainant had denied many facts which had been well established. It was noted that the complainant was very drunk .in the evening of October 30 and had said in evidence that while one constable assaulted him another constable stood by and talked to him. The second constable’s evidence showed that this situation was not possible. “I may say that the prosecution was fairly brought and all those who could contribute evidence were called,” said the Magistrate.
