OBSCENE EXPOSURE CHARGE

Magistrate Dismisses Information

(New Zealand Press Association) MASTERTON, May 5. Charges of obscene exposure brought in the Masterton Magistrate’s Court against two men who swam naked in the Ruamahanga river, near Carterton, were dismissed by Mr J. R. Drummond, S.M. He held that the exposure was neither obscene nor wilful.

The evidence of police and witnesses was that three men were observed swimming naked in the river at Kokatau. They were seen by two men and their young daughters. The Magistrate said he was not prepared to rule that a rear view was obscene. Deliberately undressing to swim was not wilful exposure as required under the act to constitute an offence.
