£11,201 DAMAGES CLAIM
Part Of Action Withdrawn (New Zealand Press Association) TIMARU, May 2. An action against the Timaru Agricultural Pastoral Association brought in the Timaru Supreme Court by John Telford Munro, who claimed £11,201 damages for injuries received when he was struck by a runaway horse at the Timaru show on October 29, 1955, was withdrawn from the jury by Mr Justice Henry today. His Honour who indicated that he would determine later whether the plaintiff should be non-suited or judgment given for the association, reserved his decision.
The hearing of the claim, which began on Tuesday, continued before the jury in respect of the second defendant, Mrs Peggy Dunn, of Fairlie, the owner of the horse. The case for Mrs Dunn ended late in the afternoon, and tomorrow counsel will make their final addresses.
A 50-year-old farmer from Waitohi, Temuka, Munro is claiming £lO,OOO general damages and £l2Ol special damages. He named the association the first defendant, and Mrs Dunn the second defendant.
After concluding his case for the association, Mr E. S. Bowie, of Christchurch, moved that Munro be non-suited, or, alternatively, judgment be given for the association on the grounds that no case either in law or in fact had been presented by the plaintiff.
His Honour announced his decision after hearing legal argument.
