PREMIER ROYAL CASE
DISMISSAL OF OWNER’S APPEAL UNANIMOUS DECISION The appeal of B. C. Lee, of Timaru, against the decision of the New Zealand Trotting Association in disqualifying him for five years. and fining him £IOO and disqualifying all horses owned by him for five years, has been dismissed by the Appeal Judges. A statement of the Appeal Judges’ decision issued by the New Zealand Trotting Association says;— “The judges are unanimously of the opinion that the appeal of B. C. Lee against the decision of the New Zealand Trotting Association be dismissed, and that the penalties imposed by the association be confirmed. "We further order that the appeal deposit of £2O be forfeited, and Lee be ordered to pay £lO towards the costs of the association, and £5 towards the costs of the conference.” The decision, dated June 9, is signed by D. E. Wanklyn, A. L. Matson, and M. G. Louisson, Appeal Judges. The board of the New Zealand Trotting Association, at its meeting on May 17, disqualified for five years B. C. Lee, owner of Premier Royal, Lee was also fined £IOO, and all horses owned by him were disqualified for five years. An official statement issued after the meeting said:— "At a meeting of the board of the New Zealand Trotting Association, B, C. Lee wag disqualified for five years and fined £IOO, and all horses owned by him were also disqualified for five years. • "Lee was charged that, being the owner of the horse Premier Royal, he corruptly entered into an arrangement with T. H. Gunning, the trainer of the said horse, that the said horse should not be a trier in the Otipua Handicap at the South Canterbury Jockey Club’s meeting on April 10, 1943, such an arrangement being detrimental to the interests of trotting. "That he was at the said meeting guilty of misconduct, inasmuch as he assaulted the said T. H. Gunning.”
