The Court of Appeal to-day reserved its judgment' on questions of law arising out of an action taken by the South Island Motor Union Mutual IriSurance Association (Christchurch), against Minsons, Ltd., A. W. Minson, and E. C. Minson. A. W. iMmson is manag-ing-director of Minsons, Ltd., and C. Minson is his wife.' . Preliminary questions in law were argued in Christchurch before Mr Justice Northcroft, following a claim by the insurance company to recover £1225 paid to Mrs Emma Jane Rule as damages for injury received when a car owned by Minsons, Ltd., driven by A W Minson, collided with her. The company acted as statutory indemnifler of Minsons, Ltd., but claimed to recover on the ground that a memorandum prepared by Minson for his own benefit constituted an admission of liability.” - , The preliminary questions argued in Christchurch before Mr Justice Northcroft were: (1) Was the memorandum an admission of liability within the meaning of the act? • (2). Does the owner for that purpose include an authorised driver? His Honour answered the first question in the negative and the second question was answered in the amrmatrln the Appeal Court the appellants are appealing against the Judge’s answer to the first question, and the respondent against the answer to the second. _______
