CLAIM UNDER INSURANCE POLICY.
COURT RESERVES DECISION. (PBXSS ASSOCIATION TILE'JBtIf) WELLINGTON, March 17. The action brought by Stephenson, and Co., Ltd., Allan Dutton Powdrell, and the Texas Oil Company (Aust.), Ltd., against Harry Holmes, of London, sued on behalf of himself and other Underwriters of a certain Lloyd's motor-car insurance policy, was continued before the Coujrt of Appeal to-day. Counsel for Holmes submitted that although the insured had sustained loss at the moment of the accident, his right to indemnity and liability upon the underwriters did not arise till the car was actually repaired. In this case the damage could not, under the circumstances be repaired, and the partial damage was.merged in the subsequent total destruction. Furthermore, the underwriters were under no liability because when the loss occurred there had been no election to pay instead of repair. The Court reserved its decision.
