RECOVERY OF FEES.

ACTION BY ARCHITECT. (press association telegram.), WELLINGTON, December 10. An action for the recovery of fees totalling £Bl9 sa, and a counter-action involving a claim for £4OOO for alleged libel and £SOO for moneys said to be due under mortgages, began to-day in the Supreme Court before Mr Justice Ostler. The parties are Oscar Albert Jorgensen, architect, of Palmerston North, and Thomas Beaumont Dwan, hotelbroker, of Wellington. Jorgensen is claiming for the recovery of £Bl9 ss, balance allegedly duo by Dwan in respect of professional services. Dwan counter-claims for £SOO for moneys allegedly lent to the plaintiff. There are three other cases to follow, .namely, an action by Jorgensen against Dwan for £4OOO damages for alleged, libel, an action by Dwan against Jorgensen for £4OO in respect of an alleged deficiency on a mortgagee's sale, and lastly, an action by Jorgensen against Dwan to set &Bide a mortgagee's sale. In the statement of defence in the first case, Dwan denied that any money was due to plaintiff for professional services, and, further, that if any sum as claimed was due then plaintiff had been paid in full, and had himself given defendant a full and complete clearance and release therefor. Defendant, in support of his counterclaim against Jorgensen, declared that in a guarantee given by him he was liable to pay on account of the plaintiff to . the National Bank of New Zealand, Ltd., at Palmerston North, £2Ol 17s 7d, and interest from July, 1930. Dwan also contended that in May, June, and July, 1929, he had advanced by way of loan to plaintiff for payment to certain contractors the sum of £450, but that only £l5O of that amount:had been paid, leaving £3OO due and owing to defendant by the plaintiff. Dwan claimed for £2Ol 17s 7d syad interest, and £3OO as balance on loan. The case is unfinished.
